Regulation Manual and Terms of Use of the internet service JOB.ORG.PL

Section 1. General Information


§ 1


This Regulation Manual defines:
1.Scope of activities provided by the Service Provider for the Users of the Internet Service, also in particular:

a. Rights and obligations of the Service Provider and the Service Users, directly related to the services provided through electronic means as well as any additional services provided through the Internet.

b.Principles of waving liabilities, saving harmless and ensuring indemnification of the Service Provider in relation to the services provided by electronic means.

c. Principles of protection of identities and personal data of natural persons using Electronic Services.



§ 2


Definitions used in the Regulations are specified as follows:

1. Service Provider – JOB.ORG.PL

2. Service User – a natural person not conducting commercial activity, a natural person conducting commercial activity, or a corporate body, who uses Electronic Services provided by the Service Provider.

3. Providing of the service via electronic means – delivery of services, which is based on sending and receiving data via data communication networks, for individual needs of the Service User, without simultaneous presence of transacting parties, where the transmission of the data is conducted by the use of public networks as defined and interpreted by Telecommunication Law.

4.Computerized information system – network of devices and software co-operating with each other, securing storage and processing as well as sending and reception of data via telecommunication network by using network-specific terminal devices as defined and interpreted by Telecommunication Law.

5. Internet service – electronic information system owned and operated by the Service Provider under the domain: http://job.org.pl and used by the Service Provider to render services to the Service User.

6. Services – all services rendered by the Service Provider via electronic means to the Service User and governed by this Regulations Manual.

7. Electronic address – identifier of an electronic information system that allows communication via electronic communication devices, particularly via e-mail.

8. Electronic communication means – technical solutions, electronic information devices and co-operating with them programming tools including, which allow remote communication between individuals and data transfer between electronic information systems, particularly the e-mail.

9. Additional Services – these are services rendered by the Service Provider to the Service User by means of electronic transmission through the Internet Service, but not included into the scope of the Internet Service.


§ 3

1. Internet service is provided on a daily basis through the Internet network under the address http://job.org.pl – owned by Service Provider and is also edited by the Service Provider. The editorial office is based in the Headquarters of the Service Provider.
2. The graphic distinguisher of the Internet service constitutes the logo which is presented in Enclosure nr 1 to this regulation manual. The Logo is a sole property of the Service Provider and its use is not allowed without written consent of the Service Provider.
3. The range of rendered services by the Internet service constitutes information services publications, offers, data base content without information related to the labour market, training and education, upgrade of qualifications, and knowledge about job search as well as any information related to labour market.
4. Any possible general advice and information which bears characteristics of instruction or advice and publicized by the Internet service or available through Internet forum is not directed to individual users in regard to their individual situation, but is only a general source of information gathered and made available by the Service for the convenience of easy search or constitutes the opinions of other users, for which the Service Provider does not take any responsibility.
5. Service Users are obliged to comply with the Regulations from the time they start using the Service.



Chapter 2. Terms of use of the Internet Service



§ 4


1. Service Users are doing so on their free will.

2. Rendering of services comes into effect after the registration and opening of an account with the Internet Service by the Service User.

3. The registration and opening of an account are free of charge and are done automatically after providing the required information by the Service User.

4. Registration is mandatory. All required fields, specially marked on the registration form, have to be filled.

5. Registration with the Internet Service constitutes the Service User’s consent to:

a. The use by the Service Provider of the data provided by the Service User to allow delivery of the service;
b. acceptance of the whole Regulations Manual;

c. Processing of User personal data by the Service Provider within the original scope entered into the Internet system during the registration process or supplemented during the later use of the system by the User.

d. Receiving of commercial information from the Service Provider or from Service Provider’s Partners, as well as receiving of distributed information acting on the order of third parties.




§ 5


All Service Users can stop using the internet service at any time. Cancellation of Service User’s account is processed by the Service Provider upon receiving a written request from the Service User. The Service Provider has the right to keep the data provided by the Service User and to use the data for a time period allowed by law, in order to fulfill the obligations set out by the service contract between the Service User and Service Provider.




§ 6


The Service Provider is not liable for delivery of services if the Service User discloses all or any of personal information that allows the Service User to log in and use the Internet service (such as User ID, Password etc.) to third parties.



§ 7

The Service Provider has the right to block or remove Service User accounts resulting in reducing or entirely blocking access to selected or all internet services if the Service User breaches the Regulations of the service, breaks the law, breaks principles of community life or if the Service User acts in a manner that causes damage to other Service Users, or if the Service User’s activity is harmful to the Service Provider or third parties.


Chapter 3. Conditions of service delivery by the Service Provider



§ 8

The Service User receives access to the service and certain parts of it upon providing required information and data or submitting a payment for such services. The Service User determines which parts of the service he/she will have access to by providing required information and data or submitting a payment for such services, the Service Provider provides the Service User with access to chosen services upon fulfillment of the aforementioned provisions by the Service User.




§ 9

1. In order to use the Internet Service certain technical requirements have to be met for the computerized information system to work properly, in particular:
a.connection with the Internet Network;

b. access to the internet browser: Internet Explorer version 5.5 and higher or Opera version 7.x and higher or Firefox version 1.x and higher or other equivalent to the above mentioned browsers. The browser should accept “cookies”;


2.The cost associated with internet connection and equipment configuration is totally the Service User’s responsibility.



§ 10


1.Certain items of the Internet Service have costs associated with them and certain are free of charge and the charges are set by the Service Provider.

2.The Service Provider sets the prices associated with the services rendered, and such information is provided in the sections directly related to such services.

3.The Service Provider has unlimited rights to make changes associated with the Internet Service with regards to its range and content, as well as to limit access to the service or temporarily stop it, without accepting any objections.

4.The Service Provider does not provide any reimbursements associated with use of the Internet Service, if the requests for such reimbursements are not based on the sole fault of the Service Provider.

5.The Service Provider reserves the right to apply permanent, promotional or periodic discounts to the rates for access to the Internet Services.

6.The Service Provider is bound to provide access to the Services within 24 hours from the opening of an account. If the account is opened on a statutory holiday, the access will be provided no later then by the end of the first business day following the holiday.


Chapter 4. Forms and types of services provided through the Internet Service



§ 11


1.The services provided through the Internet Service include:
- publication of job offers by the Service User;
- access to CV (resume) database of job seekers;
- writing and translation of CVs (resumes) and cover letters in Polish and English.

2.Publication of job offers and access to CV (resume) database are realised immediately for those who purchased access to such services. Otherwise, the services are started automatically after the payment is credited to the Service Provider’s bank account, no later then within one business day.

3. CV (resume) and cover letter writing and translation are provided within five business days from the day payment is credited to the Service Provider’s bank account.



§ 12


1. All services are provided by the Service Provider via computerized information services, using applicable electronic forms made available by the Internet Service.

2. Access to the CV (resume) database and publication of job offers are realised after confirmation that the payment is credited and entered into the system, or possible confirmation by the Service Provider or associated parties about the identity of the party placing such advertisement or ordering access to the CV (resume) of job seekers’ database; such identity search may be conducted by requesting certain specified documents and declarations from the Service User to fill out and submit in a form indicated by the Service Provider.

3.The Service Provider has the right to change the content of advertisements and CVs (resumes), as well as to refuse publication of an advertisement or CV (resume) without providing a reason, if the content of the advertisement brakes the law, the rules of this Regulation Manual or principles of community life; at the same time the Service Provider is not responsible for the content of the advertisements, their authenticity, timeliness, reliability and the existence of the Service User.


Chapter 5. Protection of personal data. Privacy policy.



§ 13


1.Due to the participation in this service, the Service Users’ personal data is accumulated and processed, which is provided only voluntarily by the Service Users. The interpretation of the act on protection of personal data from 29th of August 1997 has the Service Provider in it as the Administrator.

2. Request to remove personal data, provided to the service by the Service User, on the Service Provider’s request is equivalent with forfeiting the rights to access all or part of the Service.


Chapter 6. Complaints




§ 14


1. In case of occurrence of errors caused by malfunctioning of the system, the Service User is obligated to advise the Service Provider about such occurrences by sending an e-mail to the address: pomoc@job.org.pl


2. The Service Provider is responsible only for faults that he is directly responsible for.

3. All complaints will be investigated by the service team in a time period no longer than 14 days from the reception of such a complaint. The Service Provider has the right to leave a complaint unanswered if it is directly related to the lack of knowledge of content of this Regulation Manual, lack of compliance by the Service User with the instructions provided regularly on the pages of the Service or directly given by the Service Provider.


Chaprter 7. Final resolution.



§ 15


Content of the Regulation Manual can be changed unilaterally at any time by the Service Provider without explanation. All changes will be published regularly in the form of unified text of the Regulation Manual on the pages of the Internet Service. In case of refusal to accept the changes to the Regulation Manual, the Service User should not log in into the Internet System and immediately advise the Service Provider about such decision.



§ 16



1. The Service Provider is not responsible for the content provided by and published on the pages of the Internet Service within the generally acceptable wide legal ramifications set out by binding statutes of the law.


2. The Service Provider is not responsible for any occurrences and events that may take place or might have taken place in real world between the Service Users and without regard to their causes.


3. The Service Provider, as the owner and administrator of the Internet Service, will make all efforts to provide uninterrupted and continuous delivery of the Internet Service, however, the Service Provider does not assume any responsibility for interruptions of the Service caused by the acts of God or unlawful interference of the Service Users or third parties.


4. The Service Provider reserves the right to temporary, total or partial shut down of the service due to upgrades, additions of services, or maintenance without prior notice.

5. The Service Provider does not take any responsibility for the loss of data collected by the Service and stored in the computer systems of the Service Provider caused by a failure of the equipment, malfunctioning of the Internet system, actions of third parties or the acts of God and force majeure.

6. Copying and duplication of information and data from the Service, whehter in part or a whole is prohibited without written approval of the Service Provider, with the exception of cases permissible by the copyright law and related laws (Sec. Act 1994 Nr 24 pos.83)


7. The Service Provider reserves the right to transfer in part or entirely all rights and obligations related to the Internet Service without obtaining permission from the Service Users and without allowing the Service Users to place any objections.
